Terms of Engagement

If you choose to engage the services of Denny Morgenstern, PLLC, the terms of our engagement letter will govern the relationship between us.

The recent coronavirus outbreak has pushed more attorneys and insurance companies to transition to remote work and, as such, we also provide our services remotely via Zoom. Zoom is an extremely popular and easy to use video-teleconferencing app that is both secure and private. This video-conferencing service will allow us to remotely provide you with our full mediation and arbitration services. You simple select for your appointment to be done via video conference, and you are all set.

Our Engagement letter generally reads as follows:

Thank you for your inquiry regarding our availability to serve as a mediator or arbitrator in the above referenced matter.

We will furnish our mediation and/or arbitration services at the rate of $300.00 per hour for two party mediation or arbitration services. Three party mediation or arbitration services are furnished at $125.00 per party per hour, and four (or more) party mediation or arbitration services are furnished at $100.00 per party per hour. Arbitration services include hearings, pre-hearing conferences, pre-hearing motion practice/orders and post-hearing study/awards. We have a three-hour minimum for mediations. There are no travel, preparation or cancellation charges.

The total mediation or arbitration services fee shall be divided equally between or among the parties unless otherwise agreed to, in writing, before or at the mediation or arbitration session. Invoices will either be delivered at the conclusion of the mediation conference or arbitration session or mailed to each party or party’s attorney. Since we do not establish any direct financial relationship with any represented client(s), our engagement is with the attorney/law firm and not with your respective client(s), except in the case of pro se parties.

Disclosure: Mr. Morgenstern had an active civil litigation practice in the Tampa Bay area for 20+ years. Through December 31, 2018, Mr. Morgenstern was a shareholder in and a litigation attorney at Morgenstern & Herd, P.A. As such, Mr. Morgenstern may know or have worked with or litigated against one or more of the attorneys involved in your case. Also, Mr. Morgenstern may have represented clients regarding litigation claims against attorneys, law firms or insurance companies, including the attorneys, law firms or insurance companies named or providing coverage in your case.

As such, if you need additional information, please let us know at your earliest convenience. Otherwise, this letter will serve as a waiver of any conflict or potential conflict of interest.
